What taxes apply to betting in Kenya in 2026

A 5 percent excise duty on money deposited for gambling, a 5 percent withholding tax when money is paid or disbursed to a player's account, and a 20 percent withholding tax on winnings as defined by the Finance Act 2026. Three charges, three trigger points, three different statutes.

Why was 5 percent taken off my withdrawal

That is the withholding tax on disbursements. It is not an excise duty, despite several Kenyan guides calling it one. The excise applies to deposits.

Does the 20 percent apply to my casino winnings

Genuinely unsettled. The statutory definition confines winnings to a payout from a lottery or prize competition by a Gambling Control Act 2025 licensee. On that wording it does not reach sportsbook or casino payouts. We found no KRA guidance resolving it.

Can I be taxed without winning anything

On the mechanism, yes. Kenya's own Parliamentary Budget Office noted that a player who deposits and withdraws without betting could still face the 5 percent on the withdrawal.

Do I owe Kenyan tax on offshore winnings

An offshore operator does not withhold because it has no Kenyan licence to withhold under. Whether you have a declaration obligation is a separate question, it is unresolved in current guidance, and it is one for a tax adviser rather than an affiliate site.

Cashing out

Can I deposit to a crypto casino with M-Pesa

Not directly. M-Pesa buys USDT on a P2P marketplace, and the USDT goes to the casino. On the way back, a P2P buyer pays your M-Pesa. The casino never touches it.

How long does a crypto cash-out take

The on-chain leg settles without a payout desk. The P2P leg depends on finding a counterparty. Reported end-to-end times under 15 minutes are a best case from experienced users, not a promise.

What does it cost

Spread of roughly 0.5 to 2 percent on each conversion, plus cents in network fees on Tron, plus M-Pesa tariffs. You pay the spread twice on a round trip.

What are the M-Pesa limits

250,000 shillings per transaction, 500,000 per day, and a maximum wallet balance of 500,000, per Safaricom's published tariffs.

My withdrawal says successful but nothing arrived

Work through the five common causes before assuming the worst: an incomplete withdrawal at the operator end, a mismatched M-Pesa number, a disbursement failure, a verification hold, or a limit breach.

Regulation and operators

Who regulates gambling in Kenya now

The Gambling Regulatory Authority. It replaced BCLB when the Gambling Control Act No. 14 of 2025 commenced on 26 August 2025 and repealed Cap 131.

Is crypto gambling illegal in Kenya

Reg. 86 of the GRA Conduct Regulations restricts licensees from using virtual assets for gambling or withdrawal without approval. It binds licensees, not players. We could not confirm whether that instrument is in force, and we flag that every time.

Is Kenya blocked at Whale.io

No. Its restricted list of 13 countries, updated 14 November 2025, does not include Kenya, and the FATF-blacklist clause does not catch Kenya because Kenya is grey-listed rather than blacklisted.

How do I complain about an operator

Internal dispute resolution first, then GRA for licensees, with Safaricom 100 for M-Pesa traces and the Small Claims Court for sums under a million shillings. For an offshore operator none of that ladder exists.
